1) Service Description

Sixpent Smart Attendance is a software-as-a-service platform for attendance tracking and related payroll automation. We may update features from time to time.

2) Accounts & Accuracy

You are responsible for your account credentials, activity under your account, and for providing accurate information (including billing details).

3) Plans, Fees & Taxes

Fees depend on the selected plan and usage. Prices are shown exclusive of taxes unless stated otherwise. You are responsible for applicable taxes.

4) Subscriptions & Recurring Payments Authorization

By enrolling in a subscription or any plan with recurring charges, the cardholder authorizes PayMongo to automatically deduct payment from the given credit/debit card account until he/she revokes such authorization. The payments shall be charged at the start of each billing cycle, which shall be dependent on the agreed products/plans. After the processing of payment, the Merchant (Sixpent) shall reach out to the cardholder if his/her payment is successful or not. PayMongo shall not be held liable for the Merchant’s failure to notify the cardholder regarding the payment status. The cardholder further acknowledges and agrees that the billing cycle and amount to be deducted are dependent on the instructions made by the Merchant to PayMongo.

Additional terms

• Scope. Your authorization covers recurring plan fees, renewals, prorations for upgrades/downgrades, and applicable taxes.
• Billing cycle. Monthly/annual (or as shown at checkout/within your account).
• Notification. We will notify you if a payment succeeds or fails via email and/or in-app notice.
• Revoke authorization / Cancel. You can revoke authorization by cancelling your subscription (see Section 6). Revocation stops future charges and does not refund past charges unless Section 7 applies.

5) Payment Processing

Payments are processed by PayMongo. We do not store full card numbers. You must maintain a valid payment method and update it as needed.

6) Cancellation

You may cancel at any time via your account or by contacting [email protected]. Cancellation is effective at the end of the then-current billing period unless otherwise stated. Cancelling revokes authorization for future recurring charges.

7) Refunds

Unless required by law or expressly stated in a written refund policy published at https://sixpent.com/legal/refunds, fees are non-refundable and partial periods are not credited.

8) Price & Plan Changes

We may change prices or plan features with prior notice (typically 15–30 days). Continued use after the effective date constitutes acceptance. You may cancel before changes take effect.

9) Acceptable Use

You agree not to: (a) misuse the Service; (b) reverse engineer or circumvent security; (c) violate applicable laws; (d) infringe third-party rights. We may suspend or terminate for violations.

10) Service Levels & Maintenance

We target availability consistent with our public documentation. We may perform scheduled maintenance (with notice where practicable) and emergency maintenance as needed.

11) Data Protection & Privacy

Your use of the Service is subject to our Privacy Policy at https://sixpent.com/legal/privacy (incorporated by reference), which explains cookies/analytics, data retention, international transfers, and your rights. Payments are processed by PayMongo.

12) Intellectual Property

The Service, content, and underlying technology are owned by Sixpent or its licensors. No rights are granted other than those expressly stated in these Terms.

13) Warranties & Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties (express or implied), including merchantability, fitness for a particular purpose, and non-infringement.

14) Limitation of Liability

To the maximum extent permitted by law, Sixpent is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, revenues, data, or goodwill. Our aggregate liability arising out of or relating to the Service shall not exceed the total amount paid by you for the Service in the three (3) months preceding the event giving rise to liability.

15) Indemnity

You agree to defend, indemnify, and hold harmless Sixpent from claims arising out of your use of the Service, your content, or your breach of these Terms.

16) Third-Party Services

Certain features may rely on third-party services (e.g., PayMongo). Their terms and privacy policies apply to your use of those services.

17) Changes to the Terms

We may update these Terms from time to time. Material changes will be posted at this page with an updated effective date. Continued use after the effective date constitutes acceptance.

18) Governing Law & Venue

These Terms are governed by the laws of the Republic of the Philippines. Venue shall be the courts of Las Piñas City, Philippines, unless otherwise required by law.
